Springport Township Board Minutes
September 10, 2007
The regular meeting of the Springport Township Board was called to order at 7:00 pm at the Springport Township Hall by Supervisor Lance Mitchell.
Mitchell stated the meeting is being recorded to assist with the minutes. Once approved the tape will be destroyed.
Members present: Travioli, Mitchell and Wilson. Rybicki and Betz were absent. There were 6 visitors present.
County Commissioner Cliff Herl spoke on various issues. Meeting each week with Commissioners, soil erosion, trying to set up a contract with Livingston County for a Medical Examiner.
They approved contract with the airports and the fair had a good turnout.
Rybicki arrived at 7:04 pm.
Betz arrived at 7:08 pm.
Julianne Kolbe with Jackson County Equalization introduced herself. She gave the board information on Special Assessments.
Special Assessments can be levied by resolution or may be presented to the voters. Only real property, not personal can be taxed. As many mills can be levied as needed to fund the budget. 2 mills can be levied in July and if we need to levy more we could add to the December tax bill. The first thing is to decide what e are going to do and hold a public hearing to let the public know what we would like to do. We must then hold a second hearing to hear objections from the public. The concerns need to be addressed. Julie suggested that if we are going to do this, we should do this in the month of October. Once in place any taxpayer can go to the Tax Tribal and appeal it. This would allow enough time for it to be put on the December tax roll.
Rybicki questioned the holding of annual meeting. Julie stated this is an easier way than going through the election process. Julie stated 1 mill would bring $40,560-1&1/2 mills would bring $60,085, 2 mills would bring $80,113 and 2&1/2 mills would bring $100,122.
Julie also stated if we choose to call the assessment Public Safety this would go for both Police and Fire. We can do one for just Police or Fire is we choose. That money would be strictly for that.
Julie stated that most Special Assessments have been for fire in the past.
Rybicki stated/questioned that at the first meeting we had to have a number in mind that we would like to assess. Then in one month we may need to increase for whatever reason (purchase of equipment, etc) and we can do that. Julie stated that the amount can change each year. We must hold the annual meeting.
Rybicki asked if we decide to do this can the people force us not to? Julie responded that 10% of the owners of the land in the Township can petition for the election. This is the property owners who appear on the tax roll. Julie stated you can’t exempt property with no building. Also not on personal property. Non-exempt property is not included either.
Betz thought PA 116 were not included in Special Assessments. Julie was unsure. Betz stated that the PA 116 is refunded if it is regular millage tax the full amount is refunded. He thought there was no refund on Special Assessments. Either Julie or Tom will contact Roger Betz on this.
Julie also stated that the Treasurer collects the Special Assessment. It does not go to the county on delinquent. Discussion followed. She also stated that Fire and Police are provided as a convenience to the residents.
Public comment-Bill Russell wanted to ask about the building going up by Keeler’s.
Motion by Rybicki and supported by Wilson to approve the minutes. Motion carried.
Motion to accept and file the Treasurers report in the amount of $56,932.34 in the Savings and $54,706.30 in the checking by Rybicki. Supported by Travioli. Motion carried.
Betz stated that he and Wilson were able to do a report with the new BS& A programs that the auditors normally do. He also went to a class and suggested everyone reads the materials he received at the meeting. Jeff Mitchell questioned why the Fire owes the General fund money. Tom explained how the taxes work. Discussion followed.
Motion by Rybicki to pay the following post audit bills and supported by Travioli. Motion carried.
Motion by Rybicki and supported by Travioli to pay the Township bills in the amount of $15,918.00. Motion carried.
Motion by Betz and supported by Rybicki to pay the Police bills in the amount of $6223.00 Motion carried.
Motion by Betz and supported by Rybicki to pay the Fire bills in the amount of $22,032.66. Motion carried.
There is no police report.
Jason B. was asked by the Village to do an ordinance violation on a swimming pool. Rybicki was asked by Jason if he should do this enforcement for the village. Rybicki told him to go ahead and do this one. Discussion followed.
Motion by Wilson to have Rybicki talk to the Village about hiring the Ordinance Officer to enforce the Village ordinances. Supported by Rybicki. Motion carried.
Jason has made several attempts to go the house on Pope Church Rd but has been unsuccessful in reaching the homeowner. Jason never contacted Lance in regards to that. Lance did not call Jason due to not having his phone number.
There was no Planning Commission meeting.
There was no Fire Board meeting. That is on the 17th of the month. Rybicki did ask the Board if there was anything that the Board wanted him to bring up for discussions. The Fire Board will discuss the bi-laws in December. Discussion followed. Should set some kind of criteria or guidelines. Should also live within the Townships that they are serving.
Lance still has not done anything with the Proof of Occupancy Form.
Lance stated that at the Region 2 meeting they were going to try to get Townships to pass an ordinance so that Cell Towers can be used by Public Safety at no charge. Discussion followed. Lance was not able to make the meeting. Our ordinance states they must make room for them but does not discuss charges. Lance will check into other ordinances.
Lance also received papers from Michigan State regarding grants. Grants for buildings, road work etc. Lance will look into it and give them a call.
Lance also received papers on a meeting on September 27th at Sheridan Township hall in regards to Senior Leisure/Recreation if anyone is interested.
Wilson questioned when the bench would be put in. The Township has had if for 1 month and it is still not set. Mitchell stated he needed to find someone with a concrete drill. Rybicki said he had one, Lance will get with him.
Wilson and Betz presented the board with information on BS&A for putting assessing and tax information on line. Wilson called BS&A. We would have to network computers because the Treasurers computer is old. BS&A wants to upload information nightly. There would be no charge for taxpayers to access their information, but all others would be charged through BS&A. There would be no cost to the Township. Discussion followed. The assessor/treasurer computer needs to be updated before we could do this.
Bill Russell would like to know what is going on with the property at Keeler’s.
Wilson stated she got the application for the zoning change, but has not gotten a building permit. They go to Rod and he sends them into the Township. Discussion followed. Lance will contact Rod to see if there is a permit on it.
Rybicki has a meeting with Parma and Sandstone on Wednesday. They worked on budgets. Our share would be $70,000. Tom has looked at the General Fund and feels it is possible that we could do that from the General Fund. Discussion followed. Steve will go to the meeting and tell them we can do $70,000 for 2 years through 2009.
Betz stated the surveys have came back negative for the most part. Road construction has not been good responses either.
Rybicki checked with Northwest in regards to signs for the recycle lot. Northwest does not do them, they suggested talking to the Road Commission.
Motion by Rybicki to adjourn the meeting. Supported by Travioli. Motion carried. Meeting adjourned at 8:37.
